These SMS Terms & Conditions (“SMS Terms”) govern the text-message (SMS / MMS) program operated by Divergent Estates LLC (“Divergent Estates,” “we,” “us”). By opting in to receive text messages from us, you agree to these SMS Terms. These SMS Terms supplement, and do not replace, our Terms of Service and Privacy Policy.
The Divergent Estates SMS program (the “Program”) lets prospective and existing owner clients, vendors, and other approved contacts exchange text messages with our team. Depending on the relationship you have with us at the time you opt in, the messages you receive may include:

Opt-in is not a condition of purchase or of receiving any Divergent Estates service. Standard messaging consent applies only to the mobile number you provide.
Message frequency varies based on your relationship with us and the operational events affecting your property. Active owner clients typically receive a higher volume of messages during onboarding, peak season, and around guest stays. Prospective owners typically receive a smaller number of messages tied to a specific enquiry. We do not commit to a fixed weekly or monthly count.
Message and data rates may apply. Your mobile carrier’s standard rates for text messages and data may be charged by your carrier; check your mobile plan and contact your carrier with questions about those charges.
You can cancel the Program at any time. Reply STOP to any message you receive from us. After you send STOP, we will send you a one-time confirmation message and will not send you any more messages through the Program from the number that received your STOP request. If you want to receive Program messages again, you must opt in again as described above.
Additional keywords we recognize as opt-out requests: END, QUIT, CANCEL, UNSUBSCRIBE.

The Program is available on most major U.S. mobile carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, Cricket Wireless, MetroPCS, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages. Carriers and Divergent Estates do not guarantee that messages will be delivered to or received from any specific device, and message delivery is on a best-effort basis. We have no control over carrier networks and are not responsible for issues caused by your device, your carrier, or the network.
We collect and use information related to the Program — including your mobile number, opt-in date and source, mobile carrier, and the content of messages — as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are not shared with any third parties except as required to deliver the messages you have opted in to receive (for example, with our messaging-platform provider, Twilio Inc., and the mobile carriers that route the messages).
To enroll in the Program you must be at least 18 years old and the account holder of, or have authorization from the account holder of, the mobile number you provide.
You agree to notify us promptly if you change or deactivate the mobile number you have enrolled in the Program. Sending a message to a number that has been reassigned, transferred, or deactivated is not our liability.
We may update these SMS Terms from time to time. The “Last updated” date above reflects the most recent change. Material changes will be posted on this page; continued participation in the Program after a change constitutes acceptance of the updated SMS Terms.
